TERMS AND CONDITIONS OF USE OF USIBRILHE

These Terms and Conditions of Use ("T&C") of Usibrilhe Indústria, Comércio, Importação e Exportação Ltda. ("USIBRILHE"), a limited liability company, registered under CNPJ/MF nº 12.188.310/0001-60, headquartered at Rua Julio Marmile, nº 1032, Jardim Eden, Nova Odessa, São Paulo, CEP 13382-010, aims to regulate the general conditions of the e-commerce service ("E-commerce") provided by USIBRILHE through the website www.usibrilhe.com.br ("Site"), establishing the rules to be observed by consumers ("user clients") of the Site and by USIBRILHE itself, in accordance with Brazilian law, especially the provisions of the Consumer Defense Code (Law nº 8.078/1990 – "CDC") and Presidential Decree nº 7.962/13 (which regulates E-commerce).


1) ABOUT USIBRILHE E-COMMERCE

1.1. When browsing USIBRILHE's E-commerce, the user client will have access to all products sold by USIBRILHE and may search through the available categories.

1.2. Product information: When accessing a specific product in USIBRILHE's E-commerce, the user client will have access to photos and relevant information about that product, such as: description, size chart, composition, available sizes and colors, and product functionalities. It is the responsibility of the user client to evaluate the information provided by USIBRILHE before completing the purchase.

1.3. Payment methods: The user client may choose to make the payment of their purchase through the following means:

  • Credit card
  • PIX cash
  • Bank slip
  • Mercado Pago

1.3.1. Credit card payments: Are intermediated by Mercado Pago Instituição de Pagamento Ltda., registered under CNPJ/MF nº 10.573.521/0001-91.

1.3.2. Installment credit card payments: If the user client chooses installment payments, starting from 4 (four) installments, interest will be charged. The user client will see the total purchase amount, including interest when applicable, in accordance with Resolution nº 3.517/2007 of the Central Bank of Brazil (BACEN).

1.3.3. Purchase confirmation: After processing and authorizing the financial transaction related to the purchase, the user client will receive confirmation of the order by email from USIBRILHE. The delivery time stipulated at the end of the order will only begin after purchase confirmation.


2) ORDER DELIVERY

2.1. USIBRILHE works with several partner carriers and Correios for deliveries throughout Brazil.

2.2. To estimate the shipping cost to their address, the user client must go to the "cart" stage and enter the ZIP code. This way, they will see the available carrier options, values, and deadlines, and may choose the carrier that best meets their needs.

2.3. Products will be delivered to the address indicated by the user client, with 3 (three) delivery attempts. If delivery attempts are unsuccessful, the product will be returned to USIBRILHE, and the user client will be contacted to confirm the data and make a new attempt. In this case, the previously informed delivery time will be disregarded, and a new deadline will be counted from the address confirmation.

2.4. The user client acknowledges that USIBRILHE has no responsibility for actions and omissions that may be caused by partner carriers.


3) ORDER EXCHANGE OR RETURN

3.1. To exchange or return an order, the user client must follow the guidelines established in the "Post-Purchase Help" section of USIBRILHE, available on our Site or through customer service channels.


4) RIGHT OF WITHDRAWAL

4.1. As provided in the CDC, the consumer has the right of withdrawal. The user client may return the product they purchased to USIBRILHE, without the need for any justification, provided that the communication of such withdrawal to USIBRILHE occurs within 7 (seven) days from the date of receipt of the product.

4.2. USIBRILHE will provide the posting code with Correios so that the user client can return the product.

4.3. After receiving the product by USIBRILHE and analysis by the quality department, if it is proven that the product was not used, USIBRILHE will provide the refund of the amount due to the user client, according to the Refund Policy available on our Site or through customer service channels.


5) DEFECTIVE PRODUCT

5.1. As soon as they receive the product, if the user client notices any defect, the product must not be used. The user client must follow the guidelines provided in the "After-Sales Help" section, available on our Site or through customer service channels.


6) PRODUCT WARRANTY AND MAINTENANCE

6.1. Free Maintenance for 3 (three) months:

  • 6.1.1. USIBRILHE offers the user client free maintenance of purchased products, including shipping and maintenance service costs, for a period of 3 (three) months from the date of product receipt.

6.2. Free Maintenance up to 1 (one) year:

  • 6.2.1. After the initial period of 3 (three) months and up to 1 (one) year from the date of product receipt, USIBRILHE will continue to offer the maintenance service free of charge. However, shipping costs (freight) to USIBRILHE and for the return of the product will be the responsibility of the user client.

6.3. Conditions for Maintenance:

  • 6.3.1. Free maintenance covers manufacturing defects and issues related to the quality of materials and workmanship used in the manufacture of products.

  • 6.3.2. Excluded from the free maintenance warranty are damages caused by misuse, accidents, natural wear due to normal use, unauthorized modifications, or repairs performed by third parties.

6.4. Procedure to Request Maintenance:

  • 6.4.1. The user client must contact USIBRILHE through the available customer service channels, providing the order number or invoice and detailing the identified problem.

  • 6.4.2. USIBRILHE will provide instructions for sending the product for maintenance.

6.5. Replacement of Damaged Merchandise:

  • 6.5.1. If the user client receives damaged or spoiled merchandise, USIBRILHE undertakes to replace it at no cost to the client.

  • 6.5.2. The user client must contact USIBRILHE within 7 (seven) calendar days from the receipt of the product, reporting the problem and following the provided instructions for return and replacement of the product.

  • 6.5.3. USIBRILHE will cover all shipping costs involved in the exchange of the damaged product.


7) INTELLECTUAL PROPERTY

7.1. The elements and/or tools found on USIBRILHE's Site are subject to intellectual rights in accordance with Brazilian laws and international treaties and conventions to which Brazil is a signatory. By way of example, this includes: texts, software, scripts, graphic images, photos, sounds, music, videos, interactive resources and the like, brands, service marks, logos, and "look and feel," among others, belonging exclusively to USIBRILHE.

7.2. Users are aware and agree that the use, redistribution, commercialization, and/or reproduction of content or part of the content made available on the platform must comply with Brazilian Copyright laws, under penalty of misuse and/or infringement of third-party intellectual rights.


8) TERMS AND CONDITIONS OF USE

8.1. To make a purchase on USIBRILHE's E-commerce, the Site user must be over 18 (eighteen) years old. If underage or legally incapacitated, they must be represented or assisted by their legal representatives, as well as provide personal data for the completion of the purchase, as described in USIBRILHE's Privacy and Data Security Policy.

8.2. By using USIBRILHE's Site and purchasing the products sold, the user client declares that they have read and accepted these Terms and Conditions of Use and USIBRILHE's Privacy and Data Security Policy.

8.3. USIBRILHE's Terms and Conditions of Use and Privacy and Data Security Policy have the nature of a contract and, by accepting them, the user client will be bound by their terms and conditions.

8.4. USIBRILHE may periodically update these T&C, and its latest version will always be available at https://www.usibrilhe.com.br/policies/terms-of-service.

8.5. USIBRILHE may deactivate, block, or otherwise unilaterally terminate the user client's access to its Site, with unilateral termination of this contract, without prejudice to applicable legal measures, if:

  • (i) Any legal violation and/or breach of these T&C is identified;
  • (ii) Fraudulent acts are identified through the use of USIBRILHE's E-commerce, whether directly or indirectly;
  • (iii) If the user client causes any direct or indirect damage to USIBRILHE;
  • (iv) The user client defaults, which occurs when they fail to make payment of any installment owed to USIBRILHE under the terms agreed between the parties;
  • (v) In other cases, at USIBRILHE's discretion, if deemed necessary, due to violation of legal norms, incompatibility with its policies, among others.

8.6. These T&C may undergo periodic changes, whether for legal or strategic reasons exclusively of USIBRILHE. The user client agrees and acknowledges that it is their sole and entire responsibility to periodically check these T&C at the domain https://www.usibrilhe.com.br/policies/terms-of-service. USIBRILHE may, at its discretion, inform the user client about significant changes in the T&C. However, this discretion does not exempt the user client from the responsibility of periodically checking the T&C.
